Terms of Service

By installing, accessing, or using any NinetyFour Labs website, browser extension, application, API, or other service (collectively, the "Services"), you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.

You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the Services.

• "Product" means any specific extension, application, or tool we offer.
• "License" means the right to use a Product under these Terms.
• "License Key" means the activation code issued to you for a paid Product.
• "You" means the individual or entity using the Services.

Subject to your compliance with these Terms (and, for paid Products, payment of applicable fees), NinetyFour Labs grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Product for your own lawful purposes.

Where a Product is sold as a one-time purchase with a "lifetime license," "lifetime" means for the supported lifetime of that Product - i.e., for as long as we continue to make that Product available - and does not guarantee perpetual updates, availability, or compatibility with third-party platforms that may change over time.

Unless stated otherwise for a specific Product, a License is for your individual use. This is a license, not a sale; we and our licensors retain all rights not expressly granted.

You agree not to:

• copy, resell, rent, lease, sublicense, or redistribute a Product or License Key, except as expressly permitted;
• share, publish, or circumvent License Keys or any licensing, activation, or access controls;
• reverse engineer, decompile, or disassemble a Product except to the extent such restriction is prohibited by law;
• modify, create derivative works from, or remove proprietary notices from a Product;
• use a Product to build a competing product or for any unlawful purpose.

Paid Products are sold through our payment provider, Dodo Payments, which acts as merchant of record. Prices are shown at checkout and may change over time; taxes may apply depending on your location.

After a successful purchase, your License Key is delivered to you (typically by email) and may be activated and periodically validated by the Product. You are responsible for keeping your License Key secure and for the accuracy of the information you provide at checkout.

Refunds. Because Products are digital goods delivered immediately, all sales are generally final. If a Product is materially defective or you believe you were charged in error, contact us and we will review your request in good faith. Refunds, where granted, are handled through the payment provider and may result in deactivation of the associated License.

You agree to use the Services only for lawful purposes and in compliance with all applicable laws and the terms of any third-party platform the Services interact with. You are solely responsible for how you use the Services and for any data you enter, submit, or act upon.

You agree not to use the Services to infringe others' rights, to gain unauthorized access to any system or account, to disrupt or interfere with the Services, or in any way that could harm NinetyFour Labs or any third party.

Some Products operate on or alongside third-party websites, platforms, or services (for example, websites a browser extension runs on, or app stores and browser stores). NinetyFour Labs is not affiliated with, endorsed by, or sponsored by those third parties unless expressly stated.

Your use of third-party platforms is governed by their own terms and policies. Those platforms may change, restrict, or discontinue functionality at any time, which may affect a Product's operation. You are responsible for ensuring your use of a Product complies with the terms of any platform it interacts with.

The Services, including all software, designs, text, graphics, logos, and trademarks, are owned by NinetyFour Labs or its licensors and are protected by intellectual property laws. Except for the limited License granted above, these Terms do not grant you any rights in the Services or our brand.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that policy.

The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or compatible with any particular hardware, software, or third-party platform, or that defects will be corrected.

You use the Services at your own risk and are responsible for any actions you take using them.

To the maximum extent permitted by law, NinetyFour Labs and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services.

To the maximum extent permitted by law, our total aggregate liability for any claims arising out of or related to the Services will not exceed the greater of (a) the amount you paid us for the applicable Product in the twelve (12) months before the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless NinetyFour Labs and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

These Terms apply while you use the Services. We may suspend or terminate your access or License if you breach these Terms, if required by law, or if we discontinue a Product. You may stop using the Services at any time and uninstall any Product.

Upon termination, the License granted to you ends and you must stop using the affected Product. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date above and, for material changes, provide more prominent notice where appropriate. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules, and the courts located in India will have exclusive jurisdiction over any disputes, except where mandatory local law provides otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
